New section 399H(b)(2) of the Public Health Service Act limits eligibility to a State, Indian Tribe or Tribal organization, local government, scientific or academic institution, or nonprofit organization, and requires an application describing the activities the entity intends to carry out. Section 399H(b)(3) permits the Secretary to require the applicant to name a State or Tribal coordinator and describe an advisory committee.

A group must meet two tests to get this money. It must be the right kind of group. It must also send in a form.
The right kinds of group are named in the law. They are States, Tribes, local governments, schools, and nonprofit groups. The form says what the group plans to do.
