Save Our Seas 2.0 Amendments Act › Section 2

Modifications to the Marine Debris Program of the National Oceanic and Atmospheric Administration

Section 2 · Sec. 2 ·

What this chapter is about

This part changes an old law about trash in the sea. It puts a new heading in that law and gives four of its parts new numbers. It also lets NOAA pay part of a job's cost in work or goods instead of cash.

3 proposals indexed from this chapter.

The document says “is amendedWho acts: CongressHow: statuteSec. 2 in the PDF
What the document says

“The Marine Debris Act (Public Law 109-449) is amended-- (1) by inserting before section 3 the following: ``Subtitle A--NOAA And Coast Guard Programs''; and (2) by redesignating sections 3 through 6 as sections 101 through 104, respectively.”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2

The section operates by amendment. It puts a heading, Subtitle A, NOAA And Coast Guard Programs, into the Marine Debris Act (Public Law 109-449) before that Act's section 3, and renumbers sections 3 through 6 as sections 101 through 104. The rest of this Act cites those provisions by the new numbers.

What the document actually says

“The Marine Debris Act (Public Law 109-449) is amended-- (1) by inserting before section 3 the following: ``Subtitle A--NOAA And Coast Guard Programs''; and (2) by redesignating sections 3 through 6 as sections 101 through 104, respectively.”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2
That sentence, in plain words

An old law about sea trash is changed. A new heading goes in. Four of its parts get new numbers.

What this is about

The old law is the Marine Debris Act. Its parts 3 to 6 become parts 101 to 104. The rest of this law uses the new numbers.

No action is recorded against this proposal. That is not evidence that none has been taken, and nobody has yet read it against the record. See what the tracker does not yet cover.

The document says “is amendedWho acts: CongressHow: statuteSec. 2 in the PDF
What the document says

“in paragraph (1) by striking ``and contracts'' and inserting ``, contracts, and other agreements'';”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2

Section 101(d) of the Marine Debris Act (33 U.S.C. 1952(d)), the provision this Act renumbers from section 3(d), is amended so that its subsection heading and its first paragraph name other agreements alongside grants, cooperative agreements and contracts.

What the document actually says

“in paragraph (1) by striking ``and contracts'' and inserting ``, contracts, and other agreements'';”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2
That sentence, in plain words

The words and contracts come out of one line. The words contracts, and other agreements go in.

What this is about

That part of the old law is about deals made to pay for work. The new words name more kinds of deal. The old law is not printed here.

No action is recorded against this proposal. That is not evidence that none has been taken, and nobody has yet read it against the record. See what the tracker does not yet cover.

The document says “canWho acts: the Under SecretaryHow: statuteSec. 2 in the PDF
What the document says

“the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2

A new paragraph (7), In-kind contributions, added at the end of section 101(d) of the Marine Debris Act. Where a project is carried out under a contract or other agreement that is not a cooperative agreement and not a grant, the Under Secretary may contribute in kind the share of the project's costs that the Under Secretary determines matches the benefit the National Oceanic and Atmospheric Administration gets from the project.

What the document actually says

“the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.”

To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes, Sec. 2
That sentence, in plain words

NOAA can pay a share of a job in kind. In kind means work or goods, not cash. It pays for the part that helps NOAA.

What this is about

A grant is one kind of deal. A contract is a different kind. This rule covers the second kind only. Part 5 says where the words Under Secretary get their meaning.

No action is recorded against this proposal. That is not evidence that none has been taken, and nobody has yet read it against the record. See what the tracker does not yet cover.

What This Page Covers, and What It Leaves Out

Each thing the section does: the subtitle heading it inserts into the Marine Debris Act, the renumbering of that Act's sections 3 through 6, the widening of the grant provision so that it names other agreements, and the new paragraph on in-kind contributions.

Purely mechanical amendments. Striking a word and inserting another is recorded only where it changes what somebody must do, so the change of part of the to part of a, and the added cross reference to subparagraph (C), in section 101(d)(2) are not recorded as changes of their own.

The section works by amending the Marine Debris Act (Public Law 109-449), which is not a document indexed here, so nothing recorded says what that Act provided before this one or reads as now. A reader following a citation into it will find the older numbering until this Act is applied.
