Consolidated Appropriations Act, 2026 › Section 5017

Emergency Authority for Sentencing Commission

Section 5017 · Sec. 5017 ·

What this chapter is about

This part tells a federal panel to write sentencing rules called for by another law, and to do it by December 31, 2026. It says when those rules start. It also says this timing rule beats the one in the other law.

3 proposals indexed from this chapter.

What the document says

“The United States Sentencing Commission (in this section, referred to as the ``Commission'') shall promulgate the guidelines or amendments provided for under section 8605(e) of the SAFER SKIES Act (title LXXXVI of Public Law 119-60) as soon as possible after the date of enactment of such Act, and in any event not later than December 31, 2026, notwithstanding the deadline under section 994(p) of title 28, United States Code.”

Making further consolidated appropriations for the fiscal year ending September 30, 2026, and for other purposes, Sec. 5017

Subsection (a) of section 5017 requires the United States Sentencing Commission to issue the guidelines or amendments provided for under section 8605(e) of the SAFER SKIES Act as soon as possible after that Act was enacted, and no later than December 31, 2026. It sets that deadline notwithstanding the deadline in section 994(p) of title 28, United States Code.

What the document actually says

“The United States Sentencing Commission (in this section, referred to as the ``Commission'') shall promulgate the guidelines or amendments provided for under section 8605(e) of the SAFER SKIES Act (title LXXXVI of Public Law 119-60) as soon as possible after the date of enactment of such Act, and in any event not later than December 31, 2026, notwithstanding the deadline under section 994(p) of title 28, United States Code.”

Making further consolidated appropriations for the fiscal year ending September 30, 2026, and for other purposes, Sec. 5017
That sentence, in plain words

A federal panel must write the sentencing rules called for by another law. It must do so as soon as it can. It must finish by December 31, 2026.

What this is about

A judge uses a set of rules to help pick a sentence. A federal panel writes those rules. Its usual clock does not apply here.

What the document says

“The amendments to the guidelines promulgated under subsection (a) shall take effect 180 days after the date of promulgation by the Commission, except to the extent that the effective date is revised or the amendment is otherwise modified or disapproved by an Act of Congress”

Making further consolidated appropriations for the fiscal year ending September 30, 2026, and for other purposes, Sec. 5017

Subsection (b) of section 5017 provides that the amendments take effect 180 days after the Commission issues them, unless an Act of Congress revises the effective date or modifies or disapproves the amendment. It also provides that they supersede any contrary amendment in the guideline amendments submitted to Congress on or about May 1, 2026.

What the document actually says

“The amendments to the guidelines promulgated under subsection (a) shall take effect 180 days after the date of promulgation by the Commission, except to the extent that the effective date is revised or the amendment is otherwise modified or disapproved by an Act of Congress”

Making further consolidated appropriations for the fiscal year ending September 30, 2026, and for other purposes, Sec. 5017
That sentence, in plain words

The new rules start 180 days after the panel puts them out. Congress can pass a law to change that day. Congress can also change or reject a rule.

What this is about

Sentencing rules do not start at once. There is a waiting time. Congress can step in during that time.

That sentence, in plain words

Where this part and the older law set different clocks, this part wins.

What this is about

Two laws can each set a due date for the same job. Then one has to give way. This part says which one does.

What This Page Covers, and What It Leaves Out

The three things the section does: set a deadline for the United States Sentencing Commission, fix when the resulting amendments take effect, and state that this section supersedes a timeline in another Act.

Nothing else in the section.

The guidelines are the ones provided for under section 8605(e) of the SAFER SKIES Act, title LXXXVI of Public Law 119-60. That Act is not indexed on this site, so what those guidelines must contain is not recorded here.
